  1. The Sussex County Circuit Court erred and abused its discretion by Granting the defendant’s Plea of Sovereign Immunity upon the defendant’s assertion that Appellant Albritton failed to exhaust his administrative remedies.
  2. The Sussex County Circuit Court erred and abused its discretion in Granting the defendant’s Motion for Summary Judgment upon its finding that the Evidence produced and Submitted by Appellant Albritton was insufficient from which a jury could find the defendant guilty of negligence.
