By , Roetzel & Andress Concierge medicine is on the rise, especially in the “snowbird” states like Florida, as practices and hospitals from Chicago and elsewhere have opened concierge practices to serve their patient populations in these warm locations. As these concierge style medicine practices continue to grow all over the country in primary care, pediatrics, women’s health and other specialties, practices need to be particularly mindful of the different legal considerations that affect these new practice models. Because patient membership fees are often paid in advance and the patient agreement usually contemplates a personal relationship with increased access to a certain physician, there are different legal challenges and practice issues that should be addressed at the outset of these practices. The concierge model generally relies on increased access and time for patients because physicians have typically accepted fewer patients. Because of this, it can be very difficult to figure out the fairest way to negotiate a partner’s exit and how these patients and fees paid would transfer in the event of such departure. Does the partner get paid only in a buy-out of the whole practice or will the practice buy-out the individual partner upon his or her termination? Would this be handled differently in the case of a retirement? Would the practice consider a buy-out only if another physician can be substituted and take over the patient panel? How then is the new provider paid if fees have already been collected for a given year? It is possible the patients reject the substitute physician regardless of the departing physician’s recommendation. Oftentimes, the agreements governing the practice’s operations include long notice provisions prior to any termination or retirement because it is not easy to substitute another concierge doctor if one leaves. Also, the patients have paid for the personal relationship and membership with their own doctor, so they do not always feel that this relationship transfers to another doctor. Another thing to consider is if a doctor terminates or unexpectedly dies or becomes disabled and a new doctor cannot cover their patients, what happens to patient fees that have already been collected? The practice needs to consider whether these fees are returned to patients and then whether a new membership agreement is entered into with the new physician. All these considerations need to be addressed in the initial stages of the company’s operations. Cost Sharing/Expenses Another issue confronting concierge practices is cost sharing and how to divide expenses in this type of practice models. Practices must decide if they are allocating costs based on each physician’s patient panel size or based on their respective ownership percentages of the practice. Once you allow for different panel sizes, these differences can become quite problematic, and physicians can end up disagreeing on the fair allocation of these costs. Confronting these differences early in the formation of the practice and providing for them in the practice’s operating documents can help avoid difficult and costly conflicts later for the partners. Sales to Third Parties Physician owners in a concierge practice also need to consider at the formation of a practice how the profits of the practice will be divided in the case of a sale to a third party. Will profits be divided based on a physician’s ownership in the practice or based on an individual physician’s production and fee generation? If a practice has providers with vastly different production and patient panel sizes, then this is important to consider because the higher producing partner may want a sale to a third party to take into account these differences. Another partner may feel strongly that profits should be divided based on ownership percentages in the practice entity, which may be equal even if the providers have different numbers of patients. Frequently, the potential buyer has their own considerations for valuing the practices and may ascribe different values to each physician’s practice. The buyer may base its valuation of the practice on patient panel size and fees generated by each individual physician. Regulatory Considerations Concierge practices typically charge a fee for membership in their practice, which generally allows patients increased access to the physicians and their services. If the practice is accepting Medicare and/or commercial insurance, the fee cannot be charged for any service already covered by Medicare or insurance. Additionally, if the practice accepts commercial insurance, the fee must be scrutinized to be sure it is allowed under any agreement with a commercial payor of the practice. Some payor agreements may specifically prohibit any patient fee for membership in a practice. Some practices have reached out to their commercial payors directly when converting to a concierge practice and have had these commercial payors review and approve their patient agreements and membership fees. Coverage and Licensing Concerns Because of the unique access provided to concierge patients, some practices have added special coverage when these patients are out of state or on vacation. In light of their patients who winter in warmer climates, like Florida, California and Arizona, some practices have partnered with other concierge practices in these states to offer services to their “snowbird” patients. Health systems are taking advantage of these practice models also. For instance, Chicago-based Northwestern Medicine opened a concierge medicine office in Naples, Florida, and Ohio-based Cleveland Clinic also has opened concierge medicine practices in multiple Florida locations. Doctors, however, need to be aware that they need to be licensed in the state where the patient resides. Due to these licensing considerations, some concierge physicians are also obtaining licenses in other states to cover patients that often spend their winters in these warmer states. Final Thoughts The above issues are just some of the unique considerations facing concierge practices from Chicago to Florida and other states as well. Because each concierge practice has unique patient fee agreements to consider, there is not a “one size fits all” approach to advising these practices. Concierge practices should not overlook the unique legal and practice issues facing them, from patient fee issues to physician departures. These models have a variety of legal challenges that should be addressed at the early stages of the practice, so they do not lead to partner and patient discord later on. Connect with Jonna D. A while ago we sat down with Direct Primary Care (DPC) Physician and true "DocPreneur" in our hearts and minds, Dr. Brian Blank. We'll unpack what 2020 was like, what led Dr. Blank to move into this practice model and lessons learned along the way for others. By Michael Tetreault, Host/Editor and Dr. Brian Blank "I grew up in the small town of Waterford, PA, delivering newspapers before leaving for the midwest to study broadcast journalism at the University of Missouri. I then spent the next several years working in cable news in both Atlanta and New York. In New York, I met my wife and father-in-law, a longtime primary care physician at the Cleveland Clinic. After many late-night conversations with him, I decided to switch careers to pursue family medicine. After stops in Boston and Costa Rica, I moved to Chapel Hill, NC, where I completed medical school at UNC. I then did my residency in family medicine down the street at Duke University Hospital. In 2021, I opened Ember Modern Medicine, a practice I had dreamt about for more than a decade. By eliminating overpriced insurance restrictions, I can spend more time connecting with my patients and focusing on their health and wellbeing instead of rushing through 7-minute visits checking government boxes. My wife and I are now blessed with two beautiful daughters. In my free time, I enjoy competing in endurance sports. I’ve run more than a dozen marathons, finished 2nd in a 50-mile ultramarathon, and barely survived an Ironman Triathlon. Lately, I’ve been attending Swamp Rabbit CrossFit. What is ‘bespoke care’? What is ‘concierge’ care? Are they the same? Different?
Bespoke care and concierge care are both innovative approaches to healthcare, but they serve different purposes. By the Editor-in-Chief, Concierge Medicine Today. Words are my passion. While I’m not perfect at grammar (obviously!), I do manage every now and then to string a few thoughts together that resonate with some Physicians out there. I’m also intrigued by how our culture repurposes and rebrands words to promote specific narratives and ideas. And, ever since Mrs. Nielson, my 8th-grade Advanced Language Arts teacher, told me, “You have a gift; keep writing,” I’ve loved using words. I’m smitten by the science of language and constantly on a hunt to learn the new ways our words are being reused, rebranded, refined and redefined by our culture. One term worth revisiting is “bespoke.” If you’re not familiar with it in the healthcare context, let me explain. The word ‘bespoke’ is probably more familiar to our European healthcare audience than our North American audience and that’s okay. To summarize, I’ll do what you might be doing right now, ‘Googling’ it. 🙂 But, I’ll take it a few steps further and use Grammarly’s Generative AI Bot. According to the AI Bot: “Bespoke care represents the highest level of personalized medical attention, tailored specifically to meet the individual needs, preferences, and health conditions of each patient. This customized approach ensures that every treatment plan is uniquely designed for effectiveness and empowers patients, promoting a collaborative relationship with their healthcare providers.” Interesting, right? Advisory Board also recently unpacked the subject . Radio Advisory’s Abby Burns sat down with Advisory Board’s Solomon Banjo and Nick Hula to talk about a new era of innovation, where progress in diagnostics, treatments, data analysis, and ongoing management have the potential to revolutionize patient care through unprecedented customization. In the interview they note that bespoke care is going to be complex, Hula said. “It’s going to require clinicians who are highly skilled in a clinical sense, but also in a personal sense, really knowing what’s right for their patients and being able to adjust treatment decisions based off of all the factors that we just listed,” Hula said. For even more context, I also asked the Grammarly’s Generative A.I. Bot to contrast the words bespoke care with concierge care. Grammarly’s Generative A.I. Bot shared that “Concierge care offers a premium healthcare model that enhances the patient experience through an annual fee or retainer. This model provides patients with exceptional access to their healthcare providers, including extended appointment times, prioritized scheduling, and often 24/7 availability. While concierge care may incorporate some elements of bespoke services, its primary focus is on improving accessibility and responsiveness.” For perspective, over the last 20 years, many terms have emerged to describe primary care and its complex relationship with subscriptions and price transparency. Now, we can download an app on our devices and connect with a healthcare practitioner in moments for a nominal fee. Additionally, retail clinics in our neighborhoods now list their prices, which is a significant advancement compared to when we were kids. I mention this to illustrate that in most markets, price transparency addresses a fundamental need for convenience—a new definition of luxury for today’s consumers (i.e., patients). If you’re not well-versed in these healthcare terms, you’re not alone; they are relatively new. Concierge medicine, also known as concierge care, boutique medicine, bespoke healthcare, or private medicine, emerged in the mid-1990s, though its origins trace back several decades—an interesting story for another time. The term “bespoke care” isn’t new; like many words in healthcare, we often see familiar terms reinterpreted. A colleague, friend, and attorney encapsulated this idea perfectly during a meeting at the American Academy of Private Physicians conference in Phoenix, Arizona, in April 2015 when he remarked, “Let’s focus on substance, not labels.” I believe he’s absolutely right. While many terms have fallen in and out of favor among doctors, patients, and the media, some words have emerged as central to the membership medicine landscape today. Despite their media exposure and the efforts of physicians, many still don’t fully grasp the fundamental benefits, advantages, and drawbacks of certain terms in healthcare. Despite the various terms that have been tested in the marketplace, some physicians still struggle to understand the differences between these models. They often use terms interchangeably or promote one as a low-cost alternative while labeling concierge medicine as the expensive option. Personally, I don’t subscribe to that philosophy. (Pun intended.) Now, let me introduce you to a concept called “insideritis.” This term describes a phenomenon where organizations, especially in healthcare, view themselves solely through an internal lens, neglecting the patient experience. Author, pastor, and business leadership speaker Carey Nieuwhoff highlights the issue of insideritis and the excessive use of abbreviations in professional communication. He emphasizes the importance of using accessible language to foster understanding and connection, particularly in healthcare where clear communication is essential. Nieuwhoff notes, “Perhaps the insiders know what you’re talking about, but I don’t. Nor does anyone new or not yet embedded in your culture!” Today, patients often don’t understand the “insider jargon” that healthcare professionals use. In fact, many people today might not even know who our first president was. Here’s on last example of how old familiar words get used and this one is something you might already be aware of: Evidence-based medicine (EBM) was first coined in the early 1990s by a group of researchers at McMaster University in Canada, particularly Dr. David Sackett and his colleagues. They aimed to enhance clinical decision-making by integrating the best available scientific evidence with clinical expertise and patient values. This approach was a response to the growing need for a more systematic and critical examination of medical literature, allowing healthcare professionals to make informed decisions based on rigorous research rather than tradition or hearsay. My wife often jokes that I read 4-5 books simultaneously. It’s true! If you own a digital book reader or use an audiobook app like Audible to consume books, then you've probably jumped between a title or two as well, depending on your mood. By Editor, Concierge Medicine Today I personally love bouncing between a few titles and topics. I think the secret is listening or reading one chapter at a time once or twice a week! Then, I jump onto a podcast path, perhaps with a similar author I find interesting in the car or during a workout. But finding the right balance between learning and pleasure is important, especially FOR Doctors! Reading a few books simultaneously helps me avoid getting stuck or bored. If a book or a chapter is too slow, allow yourself to skip a track or jump a few pages. Life is too short, and there are too many great books to push through painfully. Throughout nearly the past two decades here at Concierge Medicine Today, we compiled a list of books that either I've read and found helpful or your peers and those we’ve interviewed over the years here at Concierge Medicine Today, our conference, the Concierge Medicine Forum, or our podcast, The DocPreneur Leadership Podcast, have been recommended to us on this topic. Week 1 in Concierge Medicine: Tools Needed to Start
My wife often jokes that I read 4-5 books simultaneously. It’s true! If you own a digital book reader or use an audiobook app like Audible to consume books, then you've probably jumped between a title or two as well, depending on your mood. By Editor, Concierge Medicine Today I personally love bouncing between a few titles and topics. I think the secret is listening or reading one chapter at a time once or twice a week! Then, I jump onto a podcast path, perhaps with a similar author I find interesting in the car or during a workout. But finding the right balance between learning and pleasure is important, especially FOR Doctors! Reading a few books simultaneously helps me avoid getting stuck or bored. If a book or a chapter is too slow, allow yourself to skip a track or jump a few pages. Life is too short, and there are too many great books to push through painfully. Throughout nearly the past two decades here at Concierge Medicine Today, we compiled a list of books that either I've read and found helpful or your peers and those we’ve interviewed over the years here at Concierge Medicine Today, our conference, the Concierge Medicine Forum, or our podcast, The DocPreneur Leadership Podcast, have been recommended to us on this topic. Navigating a Stressful Job Transition #FORDoctors #ConciergeMedicine
You and I can’t always choose how or when to leave a job. And sometimes life isn’t fair. The point is that today, considering the legacy you’re about to leave behind [at your current workplace], you honor the people you’ve worked beside and the patients you’ve served. A message from the Editor-in-Chief, Concierge Medicine Today A Sept. 3, 2024, MGMA Stat poll found that 27% of medical groups report having a physician leave or retire early in 2024 due to burnout, compared to 68% that did not and 5% reporting “unsure.” Even more interesting is that a larger percentage of physicians in another survey expressed a likelihood of leaving their current position within the next few years, with some studies showing up to 35% considering a departure. Whether you’re contemplating a leap into the world of concierge medicine or just daydreaming about your dream job, here are three simple questions you should consider if and when you decide to make a big move in your career! But before we spotlight those questions, we should pause for just a minute and talk about the legacy you’re leaving behind—the people and patients you’ve served along the way. Physicians leave organizations every day and continue to do amazing things. And when you end a job or a position at a hospital or practice where you’ve worked well, that’s part of your legacy, too. Legacy isn’t just about the end of your career or estate planning. You and I can’t always choose how or when to leave your job. And sometimes life isn’t fair. The point is that today, considering the legacy you’re about to leave behind, honor the people you’ve worked beside and the patients you’ve served. Legacy, as we’re discussing it today, isn’t something you should ignore because you got your feelings hurt or emotions are getting the best of you. Ignoring your legacy has the potential to undermine the life that you’ve lived and the gifts that you’ve given to the patients you’ve served, the colleagues you’ve worked next to all these years, and the opportunities you’ve given other people. So yeah, this a big deal. So asking these questions and really thinking about your legacy and who and what you’re leaving behind is an important conversation with the people around you right now. Who can you turn to for guidance? We all recognize the value of sound advice intellectually but it's crucial to seek counsel from individuals within your network who won’t simply tell you what you want to hear but rather will support and guide you in making critical decisions and help you identify your blind spots. Think about creating a list of these people and reach out to them. Consider taking them out for lunch and telling them beforehand what you’d like to discuss. This will shorten the pleasantries and help shortcut the discussion around your primary concerns about a job transition. How much time will it take to heal the emotional and psychological wounds of the past workplace experience? Emotions often play a pivotal role in our decision-making. However, what will happen in six months when you discover that the new job has its own set of dysfunctional workplace issues? Allow yourself time to heal from the weight of the last workplace experience. There’s nothing worse than finding yourself a decade from now (or perhaps retired) and still traumatized by the same set of emotional wounds you never allowed to properly treat years ago. Will you take a leap or build a runway? Financial concerns are not always the primary factor when it comes to changing careers or jobs. Often, it’s about better hours, a supportive boss, or more family time. Many physicians contemplating career transitions tend to overlook the “what if” questions: What if this doesn’t work out? What if I don’t enjoy the area? The list can be endless. When seeking career advice from trusted individuals, be cautious of platitudes. These can create a misleading sense of confidence. For instance, when you share your story, some may advise you to “Just take a leap of faith.” But where is your parachute? What does your financial runway look like if it doesn’t pan out? Others might suggest, “If you build it, they will come.” While these statements may hold some truth, they often lack a foundation in reality. If your next career move doesn’t succeed, what will you stand to lose? What are your exit strategies? How long is the contract? Who will be your actual boss? At the end of day, you and I, the colleagues you know, your friends and associates, we all have something in common. That is the unfortunate reality that we will not be remembered necessarily for our finest hours, but our final hours. That’s very sobering for all of us and the reason why we’re so passionate and repetitive about our mission – and that is to be FOR Doctors. Because at the end of the day it’s no longer about being the best Doctor in the world anymore, it’s about being the best Doctor FOR the world, FOR your patients and FOR your local community. By Editor, Concierge Medicine Today The holiday season is like a golden ticket for doctors to shine bright in your community and creatively engage with your patients! With creative thinking, time, and a clever marketing idea (or three!), I believe you can roll out the red carpet and make memorable patient and staff connections during this busy season. Here are a few bright ideas we’ve observed over the years that we hope you might find helpful! Organize a Community Charity Drive: Engaging in charitable acts can infuse your practice's office culture with positivity—it's a win for everyone involved! Consider collaborating with a local charity for a canned goods or toy drive. Reach out to a nearby charity or non-profit to find out their needs. Then, launch a giving campaign that includes information about the organization. This could be as straightforward as collecting socks and toothpaste, organizing a coat drive, or gathering food for a local shelter. You might even take inspiration from some medical offices we've seen by wrapping a large box in festive gift wrap, placing it in your lobby, and sending a social media post or email to patients about your holiday collection drive. Include easy instructions on how, where, and when they can drop off their unwrapped donations while enjoying some holiday hot cocoa (or tea, if that's more your style!). This initiative not only spreads joy but also brings smiles to your patients and staff who are eager to contribute. For instance, Children's Hospital Colorado has partnered with local charities during the holidays to encourage patient involvement and strengthen community ties. (Source: Children's Hospital Colorado annual reports) Approaches like these not only support local causes but also enhance goodwill among your community, as well as current and prospective patients and your team. What about a Holiday-Themed Patient Appreciation Event? Many concierge medical offices have decked the halls with festive parties, practice birthdays, and open houses to shower their patients with gratitude! Take a page from Mayo Clinic's playbook; they’ve hosted community health fairs during the holidays, complete with free health check-ups, tasty healthy treats, and wellness tips. It's a win-win—boosting patient loyalty while weaving stronger community bonds together! (Source: Mayo Clinic Community Engagement) Holiday Wellness Kits offer a distinctive approach to health during the festive season. One great example we recently read about was the Cleveland Clinic, which occasionally supplied kits containing hand sanitizers, vitamins, nutritious recipes, and stress relief items to patients throughout the holidays. This initiative not only demonstrates genuine care but also promotes healthy lifestyle habits and practices. (Source: Cleveland Clinic Seasonal Campaign Reports) Fun Social Media Activities: Plastic surgery, aesthetics, and concierge medicine are confidently showcasing their services on social media as if they own the stage! They’re connecting with their local social media audience and gaining new followers through holiday posts that are even more enjoyable than a snowball fight. Picture a local dentist launching their "12 Days of Smiles" celebration, delighting us with daily contests and health tips like it's confetti, all the while rewarding patients for their participation and commentary online! And let’s not overlook the pediatric doctor sporting those vibrant, eye-catching fun socks his patients love to comment about —talk about serious sock style! You could offer on your own social media accounts the opportunity for some lucky local follower to win some fun, quirky socks of their own or promote a new product or service offering you have just implemented in your practice to also help spread some holiday joy -- all the while transforming your online presence into a winter wonderland or warm, seasonable and festive commentary! Seasonal Health Workshops are another great idea worth considering. You could host festive or seasonal-themed health workshop focused on stress relief strategies, healthy cooking recipe cards for the holidays, or even some winter wellness tips strategically designed to help your patients who are new or unfamiliar with your practice. Cleveland Clinic, for example, has successfully organized workshops that highlight managing holiday stress and healthy eating. After all it’s no longer about being the best Doctor in the world anymore, it’s about being the best Doctor FOR the world, FOR your Patients and FOR your local community. Fingers crossed, some of these clever ideas have sparked your holiday spirit and inspired you to spread a little holiday cheer on the bond between your healthcare heroes and your patients. A well-written, often updated, and routinely revised Communication Policy helps maintain a healthy work-life balance, gives structure to your responses, and is critical to a successful marriage! In concierge medicine, a good communication policy and a secure messaging platform should free Physicians up to do what they do best. These two things working together should give you, your Practice and your Patients the freedom to respond to messages at their convenience, address questions promptly, and automatically document interactions in the patient's EMR. Don't look at them as a way to restrict communication. That's what the rest of healthcare attempts to do. You're different, and that's okay. A well-written, often updated, and routinely revised Communication Policy is a set of personal rules that become a matter of professional conscience. Remember, "... it's no longer about being the best Doctor in the world anymore, it's about being the best Doctor FOR the world, FOR your Patients, and FOR your local community."
